“Bobok” refers to the proprietary technology platform owned, developed, operated, and managed by Bobok Private Limited, including but not limited to all its affiliates, subsidiaries, group entities, successors, assigns, directors, officers, employees, contractors, consultants, licensors, and authorized representatives.
Bobok constitutes a software-based facilitation system designed to enable coordination, communication, and data exchange between various stakeholders in a school transportation ecosystem, including Parents, Schools, and Drivers.
For the purposes of these Terms, “Bobok” shall include, without limitation all mobile applications (Parent App, School App, Driver App), Web applications, dashboards, and administrative panels, APIs, databases, servers, backend infrastructure, communication systems including SMS, push notifications, WhatsApp integrations alerts, QR code-based identification, scanning systems, GPS tracking and route visualization features, analytics, reporting, and monitoring tools, any updates, upgrades, patches, bug fixes, or modifications
Bobok is strictly a technology intermediary platform and shall at no point be construed as a transport service provider, a school operator, a logistics or fleet management company, an employer, contractor, or agent of any Driver or School and provider of physical security services.
Bobok does not own, lease, manage, or control any vehicles, does not hire or supervise Drivers, and does not undertake any responsibility for the physical transportation, custody, or safety of students.
All interactions facilitated through Bobok occur between independent third parties (Parents, Schools, and Drivers), and Bobok’s role is limited solely to providing digital infrastructure on an “as-is” and “as-available” basis.
Bobok shall not be responsible for the conduct, actions, omissions, or negligence of any user, accuracy or completeness of data provided by users, operational execution of transportation services, real-world events beyond the digital interface.
Any reference to “Bobok” in these Terms shall be interpreted broadly to include the entire ecosystem, infrastructure, and operational framework described above.
“Users” shall mean and include any individual or entity that accesses, registers on, interacts with, or utilizes the Bobok Platform in any manner whatsoever. Users shall include, without limitation:
Each category of User is an independent participant in the ecosystem and operates under their own responsibility, obligations, and legal compliance requirements.
Users acknowledge and agree that their participation on the Platform is voluntary; that they are solely responsible for all actions performed through their accounts; that they must provide accurate, complete, and up-to-date information at all times; and that they shall comply with all applicable laws, regulations, and safety requirements.
Users further agree that Bobok does not supervise, control, or guarantee the conduct of any User; that it does not verify the authenticity, credentials, or background of Users unless explicitly stated; and that it shall not be liable for any disputes, misconduct, negligence, or unlawful acts committed by any User.
Any misuse of the Platform, including but not limited to fraudulent activity, misrepresentation, data manipulation, or violation of intended use, may result in suspension, termination, penalties, or legal action, at the sole discretion of Bobok.
“Platform” refers collectively to the entire digital ecosystem provided by Bobok, including all software, systems, interfaces, and technological infrastructure made available to Users for the purpose of facilitating communication, tracking, and coordination.
The Platform includes, but is not limited to mobile applications (Parent App, School App, Driver App); web-based portals, dashboards, and administrative panels; backend servers, databases, and cloud infrastructure; GPS tracking systems and location-based services; QR code generation, scanning, and verification systems; notification systems including SMS, push notifications, emails, and third-party messaging integrations; APIs, integrations, and third-party service dependencies; any updates, enhancements, or modifications released periodically
The Platform is provided on an “as-is” and “as-available” basis, and Users acknowledge that the Platform may experience downtime, interruptions, bugs, or technical failures; data transmission may be affected by network limitations, device compatibility, or external dependencies; certain features may be modified, restricted, or discontinued at any time without prior notice
Bobok does not warrant that the Platform will be error-free; uninterrupted, fully secure or immune to cyber threats; accurate in real-time tracking or notifications.
Users understand that the Platform is a facilitation tool only, and all real-world execution (transportation, supervision, safety, compliance) lies entirely with the respective Users.
Bobok is a pure technology facilitation platform that provides digital tools to enable communication, coordination, monitoring, and information exchange between Users, namely Parents, Schools, and Drivers.
Bobok’s role is strictly limited to providing software infrastructure for tracking and visibility; enabling QR-based student identification and logging; facilitating notifications, alerts, and communication flows; displaying location and trip-related data as received from devices and third-party services
At no point shall Bobok be interpreted, classified, or deemed as a transportation service provider; a fleet operator or logistics company; a school authority or educational institution; a childcare, supervision, or security service provider; an employer, contractor, or agent of any Driver or School
Bobok does not own, lease, operate, or manage any vehicles; employ, engage, supervise, or control Drivers; determine routes, schedules, or transportation logistics; oversee student boarding, deboarding, or in-transit safety.
All physical and operational aspects of student transportation are entirely managed and executed by Schools and/or Drivers, who act independently of Bobok.
Users acknowledge that the Platform depends on GPS signals, internet connectivity, mobile device performance and third-party communication networks.
Accordingly, Bobok does not guarantee real-time accuracy of location tracking, timely delivery of notifications, continuous availability of the Platform and error-free system performance.
Any data displayed on the Platform is indicative and informational only, and must not be solely relied upon for safety-critical decisions.
All interactions facilitated through Bobok occur between independent third parties, and Bobok acts solely as a digital intermediary. Schools operate as independent institutions; drivers operate either as independent contractors or school-appointed personnel to operate and run the vehicle; parents independently choose to use the Platform.
Bobok does not endorse, verify, or guarantee any User; assume responsibility for User conduct and intervene in operational or contractual relationships between Users.
Use of the Platform does not create any fiduciary relationship; any duty of care obligation; or any legal responsibility for supervision, protection, or safety.
Bobok expressly disclaims any obligation relating to student safety or custody, driver behavior or conduct and school operational compliance.
The Platform is provided strictly on an “As-Is” basis – without warranties of any kind; “As-Available” basis – subject to availability and technical conditions.
Bobok disclaims all express and implied warranties, including but not limited to merchantability; fitness for a particular purpose; reliability and uptime; and data accuracy.
Bobok shall not be held responsible or liable for any consequences arising from transportation delays or failures; missed pickups or drop-offs; accidents, injuries, or fatalities; miscommunication between Users; misuse or non-use of the Platform
All such outcomes are the result of real-world actions and decisions made by independent Users, and not the Platform itself.
Bobok operates in alignment with intermediary principles under applicable Indian laws, including the Information Technology Act, 2000.
Users acknowledge that Bobok’s role is limited to providing access to technology and does not extend to regulated transportation or safety enforcement activities.
All Users expressly acknowledge and agree that the transportation of students involves inherent risks, including but not limited to accidents, delays, human error, misconduct, and unforeseen events; the use of a technology platform does not eliminate or guarantee protection against such risks; Bobok functions only as a digital facilitation layer and not as a safety enforcement mechanism
Users voluntarily assume all risks associated with use or non-use of the platform; reliance on information displayed within the Platform; actions or omissions of other Users (Parents, Schools, Drivers)
Users agree that the Platform must not be solely relied upon for decisions concerning child safety; independent verification and supervision are always required.
Any reliance placed on GPS tracking, notifications and status updates are done entirely at the User’s own risk.
Users acknowledge that mobile applications may crash, lag, or malfunction; GPS tracking may be delayed or inaccurate; notifications may fail or be delayed
By continuing to use the Platform, Users accept all risks arising from such technological limitations.
All Users agree to fully indemnify, defend, and hold harmless Bobok and its Parent company, affiliates, and subsidiaries; directors, officers, employees, and agents from and against any and all claims, demands, legal proceedings, damages (direct or indirect), losses, liabilities, costs, penalties, and expenses (including legal fees) arising out of or related to User negligence or misconduct; breach of these Terms; violation of applicable laws or regulations; incorrect, incomplete, or misleading data provided; failure to perform assigned responsibilities (e.g., scanning, supervision, verification); acts or omissions of Drivers, Schools, or Parents.
This indemnity extends to claims arising from injuries, accidents, or fatalities; property damage or loss; criminal acts or negligence; and disputes between Users even if such claims indirectly involve the Platform.
This clause shall survive termination of the account and remain enforceable indefinitely.
To the maximum extent permitted under applicable law, Bobok’s total cumulative liability, under any circumstance, shall be limited to The lower of the total amount paid by the User to Bobok in the preceding 3 months, OR ₹1,000 (Indian Rupees One Thousand only).
Bobok shall not be liable for any direct damages, indirect damages, incidental damages, consequential damages, and special or punitive damages including but not limited to loss of life or injury, emotional distress, loss of reputation, loss of business or opportunity, and data loss or corruption.
Bobok shall have zero liability for conduct of Drivers, actions of Schools, and decisions of Parents all of whom act as independent entities.
Bobok shall not be liable for any failure or delay caused by natural disasters (floods, earthquakes, etc.); war, riots, civil unrest; Government actions or restrictions; network or telecom failures; power outages; cyberattacks or system breaches; and any act of criminal nature.
Bobok shall not be liable for app crashes or bugs, GPS inaccuracies, server downtime and notification failures.
If any portion of this limitation is deemed invalid by a court, the remaining provisions shall continue to apply, and liability shall still be restricted to the maximum extent permitted by law.
Bobok reserves the absolute right to suspend accounts, terminate access, restrict features, mpose penalties and withhold or deduct commissions at its sole discretion, without prior notice.
Action may be taken in cases including but not limited to misuse of the Platform, failure to perform required duties (e.g., QR scanning, trip activation), false information submission, safety violations, complaints from other Users and reputational harm to Bobok.
Bobok may impose monetary penalties, commission deductions and temporary or permanent bans on Schools, Drivers (freelance or employed by school from the school) and any other User.
All decisions made by Bobok regarding account status, penalties and disputes shall be final, binding, and non-negotiable.
Bobok is not obligated to provide detailed reasoning and enter into dispute resolution prior to enforcement.
Users expressly agree that all digital records generated by the Platform shall constitute valid and admissible evidence. This includes GPS logs, QR scan records, login/logout timestamps, trip activity logs, notifications sent/delivered, and system-generated reports.
Such records shall be deemed accurate unless proven otherwise, and Users waive any objection to their admissibility on grounds of being electronic in nature.
Platform logs shall be presumed to be tamper-proof and system-generated in the ordinary course of business. Any claim challenging such records must be supported by substantial technical proof.
All actions performed through a User’s account shall be deemed to be performed by the User. Unauthorized access due to negligence (e.g., sharing credentials) remains the User’s responsibility.
These Terms shall be governed by and interpreted in accordance with the laws of India, including the Information Technology Act, 2000 and applicable provisions of the Consumer Protection Act, 2019.
All disputes shall be resolved through binding arbitration. Arbitration shall be conducted by a sole arbitrator appointed by Bobok in accordance with the Arbitration and Conciliation Act, 1996 in English language.
The seat and venue of arbitration shall be Delhi, India. Courts at that location shall have exclusive jurisdiction.
Users agree to first attempt resolution through formal written notice to Bobok and allow a minimum of 30 days for resolution before initiating arbitration.
By using the Platform, Users consent to the collection and processing of personal information, location data, device information and usage patterns for purposes including service delivery; monitoring and analytics; and safety and compliance.
Users are solely responsible for providing accurate data and updating information regularly
Bobok shall not be liable for consequences arising from incorrect or outdated data.
Bobok may share data between Parents, Schools, and Drivers as required for functionality with third-party service providers (e.g., SMS gateways, cloud services, Meta, Payment Gateway, Email service provider, customer support portals, and hosting).
While reasonable safeguards are implemented, Bobok does not guarantee complete security, immunity from breaches, hacking, or cyberattacks.
Users agree that any claims shall be brought individually. No User shall participate in class actions, group litigation, and representative suits.
Any claim must be filed within 12 months from the date of occurrence. Failure to do so results in permanent waiver of the claim.
All rights related to the Platform, including software, design, branding, content, and features are the exclusive property of Bobok.
Users shall not copy, modify, or reverse engineer the Platform; use the Platform for unauthorised commercial purposes; or attempt to exploit or disrupt system functionality.
Bobok reserves the right to modify, update, or replace these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
Bobok may suspend or terminate access and restrict functionality at its sole discretion, without prior notice.
Upon termination of access to the Platform will cease immediately, and Bobok shall not be liable for any resulting loss.
If any provision is held invalid or unenforceable remaining provisions shall continue in full force. The invalid clause shall be replaced with a legally valid equivalent.
These Terms constitute the entire agreement between Users and Bobok, and supersede all prior communications.
